• Stage 1 - request an application form

    Please read through all of the information available on this website about buying your home before you apply for the Right to Buy and if you are unable to find the answer to the questions you may have please contact us.

    You can download a Right to Buy application form (known as a RTB1 form) from the Government's Right to Buy website, or by contacting the Government's Right to Buy Agent Service on 0300 123 0913.

    The following guidance notes will help you to complete the RTB1 form. Guidance Notes

    You should send your completed application form to:

  • Stage 2 – complete your Right to Buy application form

    Return the completed application to the Right to Buy section with the following documents for ALL applicants:

    One proof of identity document for ALL applicants which needs to be either:
    • Current valid Passport, or
    • Current full Driving Licence with photograph, or
    • Birth Certificate accompanied by a recent photograph with a letter from your Solicitor verifying your identity
      Bank statements for a FULL 12 month period for ALL applicants showing daily living expenses

      Utility bills for a FULL 12 month period for ALL applicants. The utility bills that we accept are for gas, electricity or water only
  • Stage 3 – application admitted or denied

    On receipt of your form Your Homes Newcastle will check all of the information that you have provided in your application form is correct and verify the details of any previous tenancies that you have provided.

    The Right to Buy is a legal process and suspected fraudulent applications will be investigated and could result in prosecution if it is found out that your application is fraudulent.

    The Right to Buy team will send a RTB2 Notice within four weeks of receiving your application form either:

    • Admitting your application and giving you the right to buy your home
    • Denying your application if you do not have the right to buy your home and give you the reason why we have turned your application down
    Following this our Property Services team will contact you to arrange a suitable valuation appointment time. There is no charge for the valuation.
  • Stage 4 – offer notice issued

    We will send you an offer notice (called a section 125 offer notice) telling you the price you will have to pay to purchase your home and the conditions of the sale. We will send you this:
      • Within eight weeks of your RTB2 notice being sent if you are buying a freehold property (normally a house)
     
      • Within twelve weeks of your RTB2 notice being sent if you are buying a leasehold property (normally a flat or maisonette)
      If you are purchasing a flat or maisonette, please ensure that you read and understand the information that can be found by clicking this link. You should get some independent financial advice to help you decide if it is in your best interest to buy. If you decide to buy:
      • You need to decide how you are going to fund the purchase
     
      • You will need to get an independent survey from a qualified surveyor
     
      • You will need to get a solicitor
     
      • You will need to complete the acceptance form you received with your Section 125 Offer Notice and return this to us either by post or by email along with the supporting documentation listed below.
     
      • Supporting documentation that you need to provide with your acceptance form is:
      • One proof of identity document for ALL applicants which needs to be either:
        • Current valid Passport, or
        • Current full Driving Licence with photograph, or
        • Birth Certificate accompanied by a recent photograph with a letter from your Solicitor verifying your identity

          Fully completed Anti Money Laundering form signed by ALL applicants

          Fully completed Buildings insurance proposal form (if purchasing a leasehold property)

          Proof of your mortgage offer if you are taking out a mortgage

          Proof of purchase funds/bank statement for a FULL 12 month period showing that you hold the money required to pay for the property if the money is coming from a separate (i.e. savings) account to your daily living expenses

          If someone else is gifting the money to you we require them to provide the following:   One proof of identity document which needs to be either:
        • Current valid Passport, or
        • Current full Driving Licence with photograph, or
        • Birth Certificate accompanied by a recent photograph with a letter from their Solicitor verifying their identity
        Bank statements for a FULL 12 month period showing daily living expenses. If the funds that are being given to you to purchase the property are held in a separate (i.e. savings) account we also need statements for this account for a FULL 12 month period

          Utility bills for a FULL 12 month period. The utility bills that we accept are for gas, electricity or water only

          A letter from them detailing the nature of the gift or loan that they are providing to you
  • Stage 5 – acceptance stage

    If you are happy with the price that you have been given you must return your acceptance form and the anti-money laundering form within twelve weeks of receiving your offer along with all supporting documents click here for a copy of the anti-money laundering form.

    If you have not fully completed all the required information and provided supporting documents, proof of identity or proof of address documents we will not process your acceptance form and your application could be delayed.

    Once we have all of the required information our legal team will begin to draw up the legal paperwork for the sale of your home. It takes approximately 8-12 weeks for the paperwork to be drafted and once it is ready it will be sent to your solicitor.

    If you do not accept within twelve weeks of your offer notice being issued we will send you a notice giving you another twenty-eight days to accept.

    If you still do not accept, we will assume that you no longer want to buy your home and withdraw your application.

  • Stage 6 – completion stage

    Once the legal documentation has been sent to your solicitor we will send you a notice giving you fifty-six days to complete the purchase. If the purchase is still not complete, a second fifty-six day notice will be sent.

    At the end of this period if the purchase is still not complete we will withdraw your application to buy your home.

    You will need to arrange a completion date with your solicitor and make sure your rent account and any other monies owing to YHN are fully paid prior to completion.

    If you decide you no longer want to buy your home you can withdraw at any point up to the day of completion.
